Division 296: How TAG is working behind the scenes for our clients

Recent changes to superannuation rules, including the introduction of Division 296, have raised understandable questions for many clients with larger super balances.

While much of the public discussion has focused on the tax itself, what matters most to us is something deeper: how these rules work in practice, and how they affect real people, real families and long-term plans.

Our role at TAG has always been to translate technical change into practical, workable strategies. Division 296 is no exception, but it does require a level of engagement well beyond simply reading the legislation.

Actively involved, not passively reacting

Over the last month, TAG has been directly involved in the consultation process around Division 296. This has included:

    • lodging multiple formal submissions on the draft legislation
    • meeting directly with Treasury to discuss how the rules operate in real life
    • working closely with the accounting profession and industry bodies
    • collaborating with specialist system and software providers

This level of engagement allows us to do more than just interpret the rules after the fact. It allows us to help shape how they are applied, particularly where technical design choices can lead to unintended outcomes.

Why does this matter to you?

    • Division 296 introduces new complexity into superannuation, including:
    • how earnings are measured and allocated for this new tax
    • how super balances are assessed at key points in time
    • how long-term decisions interact with estate planning and family outcomes

These are not issues that can be solved with a single transaction or a one-year view. They require careful thinking, reliable systems and a long-term perspective.

Our objective is to ensure that technical rules do not drive poor real-world outcomes for clients simply because they were not designed with enough practical insight.

Practical solutions to technical problems

Throughout our engagement with Treasury and the profession, TAG has been focused on a consistent principle:

Good policy should be able to be implemented sensibly, efficiently and fairly.

That means:

    • identifying where rules may create timing issues or unintended consequences
    • advocating for approaches that reduce unnecessary cost and complexity
    • supporting systems and processes that provide certainty over time
    • helping advisers and accountants deliver better client outcomes

This work is detailed, technical and often invisible, but it directly benefits clients by reducing risk and improving clarity.

Education as a cornerstone of better outcomes

TAG is also playing an active role in educating the accounting and advisory profession on the practical implications of Division 296.

We are collaborating with professional bodies, including Institute of Financial Professionals Australia, to deliver in-depth training on how these rules interact with real client situations.

Well-informed advisers and accountants are better equipped to:

    • identify issues early
    • ask the right questions
    • work collaboratively on long-term solutions rather than short-term fixes

What you can take comfort in

While Division 296 introduces change, it does not mean constant upheaval or rushed decisions.

It means thoughtful planning matters more than ever; good advice must look beyond a single tax year. The collaboration between advisers, accountants and systems is critical

TAG’s commitment is to stay ahead of the detail, engage constructively with those shaping the rules, and bring that insight back into practical strategies tailored to each client’s circumstances.

What happens now?

The work around Division 296 is ongoing. As legislation is finalised and regulations are developed, TAG will continue to:

    • monitor changes closely
    • adjust strategies where needed
    • communicate clearly and calmly with clients

Our focus remains exactly where it has always been – turning complex rules into clear, confident decisions that support your long-term financial wellbeing.

If you have questions about how these changes may affect you or simply want reassurance that your strategy remains on track, we are always here to talk. Email us or call us 0n 03 9886 0880.
